Music mogul Sean Diddy Combs , also known as P Diddy , who is in federal prison in New Jersey , is facing new sexual assault charges in California . The Los Angeles County District Attorney's Office confirmed on Monday that a new criminal investigation has been opened against Combs, 56, as he seeks to challenge a federal conviction, the Metro reported.
Venus D. Dunn, communications director for the District Attorney's Office, said the Los Angeles Police Department and the Los Angeles County Sheriff's Department have separately presented the results of their investigations into the claims of one alleged victim. She added that the case is under review.
Accusations from publicist Jonathan Hay
The alleged victim is well-known publicist Jonathan Hay, who filed a civil lawsuit against Combs in July 2025. In the lawsuit , which was seen by the Daily Mail, Hay claims that the rapper sexually assaulted him . He also filed a police report the same year, alleging that Combs sexually assaulted him in 2020 and then again in 2021.
According to TMZ, which first reported the investigation, Hay filed the complaint in his hometown of Largo, Florida, but the case was transferred to Los Angeles because the alleged crimes occurred there.
In the civil lawsuit, Haye claims he was hired to help remix a song recorded by Christopher Wallace, better known as the Notorious B.I.G., who was killed in a shooting in 1997 at the age of 24.
Hay worked on the Biggie Smalls project with his son, C.J. Wallace, who is also named as a plaintiff. The lawsuit alleges that Wallace participated in a conspiracy to allegedly "enable or assist Combs" in committing the sexual assault.
According to the lawsuit, Combs, who was a close friend and collaborator of Wallace, came to the studio in September 2020 during the recording session. He allegedly criticized the music and encouraged Hay to take ketamine to make it sound better. Hay claims he then went with Combs and some of his entourage to a warehouse in Los Angeles where Notorious B.I.G.'s clothing was being stored before it was donated to the Rock and Roll Hall of Fame.
The lawsuit alleges that Haye was left alone in the room with Combs, who allegedly masturbated on his late friend's T-shirt. Combs then allegedly ordered Haye to orgasm, ejaculated on the T-shirt and threw it at Haye, saying, "Rest in peace, B.I.G."
Haye further claims in the lawsuit that the situation escalated in March 2021, when Combs allegedly grabbed him by the head and forced him to perform oral sex against his will. The publicist claims that the experience led to suicidal thoughts.
Combs' lawyer denies the allegations.
Representatives for Combs did not immediately respond to a request for comment. He has previously denied all charges. In November 2025, Jonathan Davis, Combs's civil litigation attorney, issued a general denial in response to Hay's lawsuit.
"As Mr. Combs' legal team has stated repeatedly over the course of more than a year, he cannot respond to every unfounded accusation in what has become a media circus. To be absolutely clear, Mr. Combs categorically denies as false and defamatory all allegations that he sexually assaulted anyone. He looks forward to defending himself in court, where such matters are resolved based on valid and substantive evidence, not mere speculation and unfounded allegations," Davis said.
"Justice will be served"
In a statement to the Daily Mail on Monday, Hay called himself a survivor of Combs' abuse and said that "the fact that his painful experiences have been heard and validated by the Los Angeles Police Department and the Los Angeles County District Attorney's Office is an undeniable milestone."
"This progress represents a significant victory in my fight for full accountability. I am confident that justice will be served and that accountability will be carried out to the end," he said.
Combs's existing verdict
The new investigation in Los Angeles comes after Combs was found guilty in federal court on two counts of soliciting prostitution. However, a jury acquitted him of the more serious charges of racketeering and trafficking for the purpose of sexual exploitation.
In October of last year, the music mogul was sentenced to four years in prison, reduced by the one year he has already served in custody, and five years of probation. According to data from June 1, Combs is scheduled to be released in late February 2028.
