The court passed decisions by which the proceedings for 10 defendants in the "Moqnik" case are stopped due to statute of limitations, while the trial for the crime of "fraud" continues for the three defendants Milos Miloshoski, Milossim Vojneski and Antonio Miloshoski.

-At today's main hearing on the case with KOC no. 2616/20 from known as "Mocnik", the competent public prosecutor reclassified 10 of the defendants to the crime of Abuse of official position and authorization from Art. 353 para. 2 cc with para. 1 cc with Art. 22 of the CC in art. 353 paragraph 1 of the CC and in accordance with the provisions of art. 107 and Art. 108 of the Criminal Code requested the application of the milder law, the Basic Criminal Court Skopje informs.

The court, acting on the proposal of the public prosecutor and in accordance with the provisions of the Criminal Procedure Code, issued decisions by which the proceedings for the accused are stopped due to the statute of limitations, while for three of the accused - M.M., M.V. and A.M. the trial for the crime of "fraud" from art. 247 para. 4 cc para. 1 cc with Art. 22 of the CC continues to the next hearing scheduled for November 9 and 28, 2023 at 10:00 a.m.

"Mojnik" is a case opened by the former Special Public Prosecutor's Office. The first and second defendants in the case are Milos Miloshoski and the former mayor of Makedonski Brod, Milosim Vojneski, and the third defendant is MP Antonio Miloshoski.

According to the Prosecutor's Office, the first and second accused are accused of having committed "fraud", the third accused of having committed "fraud" and "abuse of official position and authority". With the indictment, the other 10 covered persons were accused of having committed "abuse of official position and authority".

- During 2011, the first and second defendants, jointly, with the intention of the first defendant obtaining an illegal property benefit, misled the councilors in the Council of the Municipality of Makedonski Brod, by falsely presenting and concealing facts about the legal status and real value of the real estate - subject to sale. They led the councilors to pass a decision on the alienation of immovable property, which the councilors considered to be the "former cooperative home", and in fact they approved the alienation of a building with a useful area of ​​157m2 with a yard of 3.920m2 in the village of Ižishta-Municipality of Makedonski Brod, which was used by the municipality of Plasnica, the Prosecutor's Office announced.
